The Enugu State chapter of the People’s Democratic Party (PDP) has called on the Enugu State Independent Electoral Commission (ENSIEC) to immediately declare vacant the seats of the 260 councillors who recently defected to the All Progressives Congress (APC).
This was contained in a statement jointly signed by the Chairman and Secretary of the PDP Caucus in the state, Dr. Godwin Udibe and Chief John Nwobodo (Esq.), and made available to newsmen on Sunday in Enugu.
The party threatened to institute legal action to stop further payment of salaries to the affected councillors, describing their continued stay in office as “illegal and unlawful.”
“We call on ENSIEC to immediately conduct bye-elections to fill the 260 councillorship seats, which have become vacant due to the defection of the councillors to the APC,” the statement read in part.
It would be recalled that all 260 councillors in Enugu State, elected on the platform of the PDP, defected to the APC on October 14, 2025.
Citing the provisions of the law, the caucus referred to Section 24(1)(d) of the Local Government Law No. 13 of 2020, which states:
“A member of a Local Government Council shall vacate his seat in the Council if, being a person whose election was sponsored by one political party, he resigns from that party or becomes a member of another political party before the expiration of the period for which the Local Government Council was elected.”
The PDP said that in order to prevent wasteful expenditure of public funds on the defected councillors, it would seek judicial intervention.
“We shall immediately approach the court to obtain an order restraining the government from paying salaries to the councillors,” the caucus added.
