The Senate has moved to prevent Anambra State Governor, Prof. Chukwuma Soludo, and other governors from interfering with local government funds.
Senator Tony Nwoye of the Labour Party, representing Anambra North, raised a motion citing concerns that some State Governments are trying to by-pass a Supreme Court judgment by passing counter-laws through their State Houses of Assembly.
Nwoye’s motion, co-sponsored by nine other senators, includes six prayers for enforcing the judgment.
However, Senator Adamu Aliero of the Peoples Democratic Party, representing Kebbi Central, argued that further debate on the motion is unnecessary, as Supreme Court judgments are enforceable nationwide according to Section 287 of the 1999 Constitution.
Senate President Godswill Akpabio supported Aliero’s point, noting the importance of amending Section 162, Subsection 6 of the 1999 Constitution to ensure the full implementation of the Supreme Court ruling and prevent interference with Local Government funds.
